Yes you can transfer based on the receipt number. There is not restriction on how many H1B petition can be filed on your behalf by different employers simultaneously. As long as you have no GAP in your paystubs during this transition you should be OK. I have gone through this experience in the past without any issue.

I tried a few times for scheduling infopass trying to get Boston which is closer to where I live. But I am getting Lawrence....I guess Boston office is flooded with appointments...Didn't know that Lawrence has a office too.

Will let you guys know if the meeting is of any help (which I doubt)...

I have an approved I-140 and my 3-year H1-B extension is currently being processed but not in premium and has not been approved yet.

I have decided to leave the job/country and want to know if there were any consequences of leaving without the approval (current I-94 has a July 2010 expiration date). I am still working and technically in status as it is in process but the approval could take a few more months. Should I push for premium? Any advice? I would hate to have any problems with getting future visas to the US, either tourist or getting back on an H1-B.

I want to change my job from an university to a company.

I know I have to apply for industrial H1b , but I am not sure whether I MUST wait till 1st Oct to start work.

My Father is applying for Citizenship in Nov 10. If he becomes Citizen then can I file I485 under F3(married sons and daughters of citizen parents). Category and port priority date of May 03 from my employment base I-485 to I-485 under F3?

We can't mount fire-fighting operation on each and every front. Let's ignore them.

We have a purpose to tell, educate, highlight the issues we all legal immigrants face. This has happened under this Republican Regime. Various reasons - mainly lack of funds, lack of green card numbers, lack of staff etc.

We can continue writing small specific personal letters to lawmakers. Then as a group we address employers asking them their effort to help them best employees.

I was browsing the jobs forum on craigslist and i was shocked to see some user urging people to call Senator Cornyn to not push H1 and Eb visa increases.

The General rule is You are eligible for H1B extn if the following conditions are met

a) Labor applied on your behalf atleast 1 yr prior to maxout date. You will be eligible for 1 yr extensions

b) Labor and I-140 approved in that case it will be 3 yrs extensions

Now I was in similar situation where in i applied for labor in 6th yr, Labor got cleared in 2 months, I-140 got cleared in 2.5 months so now i am eligible for 3 yr extn.

These days Labor certifications are taking a bit longer time (Atlanta is the only place they are doing it ) So it may take more time. Also one another thing needs to be considered is if there is any RFE then it takes longer.( Few cases pending beyond a year)

Do a research on various RFE and do your paperwork in much more details you will probably end up without any RFE on your case

I'm not sure, but it does not sound like something positive. The only positive might be that they are looking at your file instead of putting it in some warehouse somewhere. I came across this thread where people were discussing this issue last year. You might want to take a look, there apparently were a variety of guesses for this. However it might be some sort of internal check/audit.

Hi,

I am going to get married next week.

I am a H-1b visa holder and I have applied for green card. I am waiting to get approval of I-140.

I want to file the H-4 visa for my wife and I have couple questions :

1) How difficult is to apply for H-4 ? Do I need a lawyer for that ?

2) How will my new status effect my green card application ? Do I need to apply again for I-140 ?
