    Ok! Thought of starting this thread to track EAD/AP/FP notices and updates for early july filers. This way we can see if there is any kind of pattern going on. My details below:


    I-140 cleared from TSC
    485 filed july 2nd with NSC
    Checks cleared on 9/4 and got RN# starting with SRC (TSC)
    USCIS Case update shows "Last update" as 9/3 for EAD/AP.

    Hi,
    I came to the USA on F-1 student visa which is expired on 2005. Currently I have H1B status (I-797 form) (and NOT a stamped visa) and I-94 attached to the I-797 form.

    My question is that. Can I visit Canada for less than 30 days and coming back without the need to get a visa (automatic visa re-validation) OR I have to get a visa?

    I am worried because I never have a stamped H1B visa on my passoprt. Only H1B status + I94 which are not attached to the passoprt?

    I need your help and how can I make sure as I do not want to lose my job.

    Hi all
    I have I-140 approved from Company A . Company B applied for my H1B extn based on Company A's approved I-140 and got 3 years extension till 2011.

    My question:
    can I switch to company C now and get 3 more years extension again.? My I-140(company A) has not been revoked and priority date is not current.I want to start my PERM only after joining company C .

    If you are able to get the extension from company A to company B, what is stopping to get the extension for company C. I believe you should be able to get one. Go for PP....

    You can use the approved I-140 from company A to get a 3 year H-1 for company B assuming your priority date is not current. However, because you have not been working for company A, you are technically not in valid non-immigrant H status and though Company B's H-1 petition should be approved for three years, the extension may not be granted. This means that at some point you would have to leave, get a new H visa and then return.

    Hi, I have been searching for appointments in Canada for a while now, and have had no luck at all. I check the nvars website everyday, but it always says no appointments available. I read some posts here about how hard it is to find appointments, and started checking in the afternoons during work like they mentioned. I search in montreal, toronto, and vancouver but I don't find anything. Don't even need one for next week - anytime is ok.

    Also, I looked at some services like XVARS and NvarsAppointment - does any one have any experience using these services?

    Please advise!

    My PD is 2006 under EB-2 category. My family and I filed for GC on the same day. Now, I am planning to file a new I-140 under EB1. My kid is going to be 18 soon. What is the age limit for dependent to file for GC with the parents?

    Those of you planning to reach the 485/EAD "heaven". Please have a look at this
    link suggesting you apply for EAD 6 months in advance.

    Apply too early and you are screwed by an early approval that will render your EAD valid for just 6 months(my last 2 were approved within 2 weeks). Apply too late and risk unauthorised work and or having to get fired/stay off the job.
    All this just weeks after they removed the ability to get an emergency 90 day EAD at the local field offices if they delayed more than 90 days.
    The USCIS is getting very mean with those of us waiting in the legal queue in my view. A lot is going on behind the scenes, I hope we are not all made scapegoats of dumb policy in the end.

    Is university h1 the same as non-proft cap exempt h1 or is it different ?

    Its the same as a university comes under "Higher Education".

    Here is my story -
    - I came here in 1998 on F1
    - Transferred to H1-B in 2002
    - Filed for Labor Cert in 2005 (EB3) in Nevada
    - I-140 approved in 2008
    - I-485 pending for more then 180 days as of 2008
    - EAD valid through 7/10/2009
    - Got laid of in Feb 2009
    - I got a job as an associate, a consultancy firm on W2 basis on Nov 17th, 2009 in WA

    I have not done anything (i.e.informing the USCIS about job change etc.). I have the following questions.

    - what documentation is required to be submitted to the USCIS about the new job.
    - What kind of documentation is required from the employer vs myself
    - When/how soon has this documentation is to be submitted
    - When do i need to apply for my renewal of my EAD card
    - What documentation is required to be submitted for the EAD renewal from employer vs myself
    - Is it advisable to employ the services of an attorney if we run into issues.
    - I worked on similar job for very short stints in between, but it was for a few weeks, does it endanger my case in anyway.


    Any advice would be greatly appreciated.

    Hello Friends,

    My wife is on F1, doing her masters and is done with her course work, just left with one project (2 credits). Her college has the option of getting CPT (curriculum practical training) signed till the time her masters is not complete and then she is allowed to work off campus for 40 hours (full time).

    I have also filled for my 485 application, so I was wondering what is her status now after filling for 485 . Also is it fine if she gets her CPT signed now after filing I485. I just want to be sure that getting her CPT signed has no negative impact on our I 485.

    Any suggestions or anyone in similar situation

    I suggest you contact your lawyer to make sure it won't be a problem.
    Working on CPT is part of maintaining F1 visa status and your case is same as being on F1 visa while ones I-485 is filed.

    - If I get a new H1 sponsored (NOT a transfer of existing H1) and join a new company in a totally different job family (New H1 is not an issue because it is from a H1 cap exempt organization)

    AND

    - Also maintain the current H1 (I will continue part time work here to get minimum wage)
    - Will continue my GC process with this co


    I know this is possible but I want to know if there are any potential issues here that can jeopardize my current GC process. I am willing to do this only if my current GC process is not hurt in any way.

    the second H1 should be marked for concurrent employment. As long as you follow all rules of the H1 LCA, there is no problem.
