Unless you need to travel immediately, I551 stamp is not important. I am assuming she only declined to stamp the I-551 but the GC was approved.
These days you get the card in 30-60 days from approval. sometimes even within the week so you dont need the stamp. The actual GC card is the I-551 document you need. The stamp let you travel without the card in the days it took around a year for the card to arrive.
Congratulations and get the passport renewed, you would need the current passport for travel anyways.

Just for a change in topic, do you guys to know good Life insurance company who do not show prejudice between greencard holder and H-1B Holder.
I just got life insurance through select quote, west coast which coast only 22$ for million insurance rejected me stating that there is a difference rate of green card holder and Alien.
I got through Prudential which is costing me 50$.
Any experience with you folks
That makes sense. A typical H1B has more things to worry about (maintaining status, keeping job, GC, dealing with rogue employers, attorneys, physicians...) and lower life expectancy :D

I wanted to share this with all of you. This is my attorney & friends (who is American) thoughtful response to a thread below :-

Donna:
What is the source of your facts about immigrants?? Immigrants also pay A LOT into the
system
MOST "IMMIGRANTS" AS YOU SO LOVINGLY CALL US, ARE LAWFULLY IN
THE UNITED STATES (BELIEVE IT OR NOT!!!) AND THEY ALL WORK A LOT
HARDER THAN MANY AMERICANS ARE WILLING TO WORK!!!!
MANY MANY THOUSANDS OF DOLLARS ARE PAID INTO THE SYSTEM BY
THEM EACH YEAR. THOSE HERE ILLEGALLY NEVER HAD, AND NEVER WILL
HAVE THE RIGHT, TO GET ANY OF THE MONEY BADK - EVEN WHEN THEY
HAVE REFUNDS DUE THEM. THE IRS JUST K E E P S IT F O R E V E R AND
IT, HOPEFULLY, GOES TO AMERICANS WHO ARE NOT IMMIGRANTS!!!
GREEN CARD HOLDERS (ALSO "IMMIGRANTS") HAVE WORKED HARDER THAN
AMERICANS DO - AS I MENTIONED AND THEY ARE CLEARLY ENTITLED TO GET
THE BENEFITS THEY HAVE EARNED.
DO YOU FOR ONE MOMENT THINK THAT THE SSA WILL GIVE THE ILLEGAL
IMMIGRANT ANY SOCIAL SECURITY?!!????
NEVER HAPPEN - NEVER HAS HAPPENED!!!! IF THEY FALSIFY INFO TO ANY
GOVERNMENT AGENCY - THEY WILL NECESSARILY GET CAUGHT GO STRAIGHT
TO FEDERAL PRISON FOR AT LEAST 2 YEARS AND THEN GET DEPORED. THIS HAS
BEEN THE LAW FOR DECADES AND IT IS ENFORCED!!!!
EVEN THE LEGAL IMMIGRANTS HAVE TO BE CAREFUL ABOUT GETTING THE
SSA THAT IS DUE THEM. THEY GET CHEATED BY THE SSA EVEN MORE THAN
US CITIZENS DO IN THE NORMAL COURSE OF SSA DAILY STEALING OPERATIONS
- IF THEY LEAVE THE COUNTRY FOR TOO LONG (FOR EXAMPLE IF A PARENT GETS
SICK AND THEY HAVE TO GO AND TAKE CARE) THEY JUST L O O S E ALL
THEIR BENEFITS PERMANENTLY - EVEN THOUGH THEY MAY HAVE BEEN BEEN
HERE AND WORKED FOR MORE YEARS THAN MOST AMERICANS DO. THIS
KIND OF DISCRIMINATORY CONDUCT BY GOVERNMENT AGAINST LAWEUL
PERMANENT RESIDENTS HAVE CONSISTENTLY BEEN HELD TO BE CONSTITUTIONAL
BY THE SUPREME COURT EVEN EVEN THOUGH IT IS CLEARLY UNFAIR. THESE
BENEFITS CAN BE REFUSED VERY EASILY FOR THE LEGAL RESIDENTS WHO
WORKED HAS DOUBLE AND TRIPLE JOBS FOR FIFTY OR MORE YEARS.
WHO BENEFITS FROM THIS? YOU GIVE THE ANSWER!!!
LIGHTEN UP AND LEARN THE REAL FACTS.
ALL IMMIGRANTS ARE NOT ILLEGAL. IN FACT, MOST IMMIGRANTS ARE
LEGAL AND WORK THREE AND FOUR JOBS - DO YOU WANT TO WORK SO
HARD?? HE..- NO!!!!!
PASS THIS ON TO ALL THE PEOPLE YOU KNOW SO THAT THEY CAN BE
EDUCATED ABOUT ANOTHER MORE FACTUAL ASPECT OF THE MATTER.

Subject: Social Security Insult
This is an insult and a kick in the butt to all of us...
Get mad and pass it on - I don't know how, but maybe some good
will come of this travesty.
If the immigrant is over 65, they can apply for SSI and Medicaid and get
more than a woman on Social Security, who worked from 1944 until 2004.
She is only getting $791 per month because she was born in 1924 and
there's a 'catch 22'.
It is interesting that the federal government provides a single refugee
with a monthly allowance of $1,890. Each can also obtain an
additional $580 in social assistance, for a total of $2,470 a month.
This compares to a single pensioner, who after contributing to
the growth and development of America for 40 to 50 years, can only
receive a monthly maximum of $1,012 in old age pension and
Guaranteed Income Supplement.
Maybe our pensioners should apply as refugees!
Consider sending this to all your American friends, so we can all be
ticked off and maybe get the refugees cut back to $1,012 and the
pensioners up to $2,470. Then we can enjoy some of the money we were
forced to submit to the Government over the last 40 or 50 or 60 years.
Please forward to every American to expose what our elected politicians
have been doing over the past 11 years - to the over-taxed American.

No real evidence but when I had looked into doing this for my parents this is what I found out -
You can apply for an extension - but would need to give a valid reason with proof along with a confirmed return air ticket for a later date. Some reasons that get accepted with the correct proof:
1. More travels planned within the US - provide itinerary with dates and reservations of where the travels are planned for. And a confirmed return ticket to India later on.
2. Medical - maybe a letter from the doctor may suffice but they would need to still have good explaination and this may not fly for a 6 month extension.
3. Marriage of a family member in the US with wedding invitation and a confirmed return ticket to India after the wedding has occured.
4. Any other valid reason with proof...
I had consulted an immigration attorney and he said that he could prep the paperwork for me - the form itself is very simple, you need to attach an explaination for why you are asking for an extension and this needs to be done properly.
Another thing the attorney told me was - USCIS had become more stringent than before on giving the extensions (not sure how stringent though as he said that one could get an extension with the right documentation provided). Also one needs to provide proof of funds to support your parents while they will be here - you can provide your bank statements, pay slips, etc for them...
Also the attorney had mentioned that if they did grant an extension one time - most likely they would not do this again in the future (once in a life time thing sort of deal). Best bet is to go back and save your extension for a later time when you would utmost need it.
Traveling out of the country and returning in one month used to happen a lot in past years - officers at POE have become more strict and may see that you were just here for 6 months and are back this quickly. The officer at POE would ask you the reason for a visit this quickly and may grant you a one month or a three month stay - completely in the hands of the officer at the POE (you may still get six months but it's all luck at this point).
Good luck with whatever you decide to do.
Hi Everyone,
I learnt recently that my parents have started showing early signs of Alzheimers. They have a 10 year multiple visa. For now I have them staying with me and their 1-94 date is coming up next month.
I wanted to know what options do i have and what would be the repurcursions.
1. extend thier stay. if so, whats the process.
2. let them fly back to India. stay for month and revisit for anothe 6 months. any catch or restriction on this.
Its just that they have no one in india to take care of them and people are cheating on them due to thier medical condition.
Your opinions and suggestions will be greatly appreciated.
Thanks

I wonder why she would have to get her H4 stamped? If she has an EAD and the AP - she should just use that. Isn't AP meant just for that? - To ignore the stamping hassle and just return safe.

Hello,
My EAD (based on I-485 for EB-3; PD - July 2003) expires in the first week of Nov and I applied for my renewal in August and got a notice stating that my application has been received and it will be processed.
I have not received the new EAD yet (status on the website says 'Initial review') and chances are that I may not get one before the current EAD expires.
Am I dead in the water? Both my wife and I need EAD as our H1 has expired and we have changed jobs.
Obviously I am worried sick,
Any help, pointers, suggestions are much appreciated.
Thanks,
Few Suggestions..
Contact USCIS to expedite the case. Usually they do it 90 days after they received the case. After this do the following..
- Contact ombudsman office
- Contact local senator office.
- Contact local congressman office
Good Luck.

Folks,
As many of us get ready to use AC21 to switch from current employers, i wanted to get your feed back on a very common contartual obligation.
...
...
Now my employer had nothing to do with me getting my clients, i do my own marketing and negotiationas, but of course the employer signs on all the papers. Will i still have to change clients when i switch employer?
Whatever work related activities you do, including finding new clients, while employed, belongs to the employer (unless you have an agreement to the contrary, which you don't). Therefore, when you leave the employer, as per agreement you have, you can not take those clients with you.

One option for you would be to consider looking for another job which meets your expectations. You can ask your new employer to file a new Green card PERM. After PERM approval you can file a new I-140 along with a request to transfer your priority date (PD) of Nov 2004 from the old I-140 to the new I-140. This way you can keep working in the job or profession of your choice while not sacrificing any of the time you have originally invested in the 1st Green card process. Hope this helps.

The original poster said that she was "laid off". So the question of her sponsoring company paying her does not arise. And hence she is without a job and she knows it. On this basis I said that it would be considered fraud if she goes for H1B stamping.

Yes, ICICI bank do not allow more than 4 part pre-payments in a year. I am not sure if it is a calendar year. You can ask ICICI for the part pre-payment terms. When I inquired, they sent me a PDF file.
I had this issue because I wanted to pay-off my loan to avoid the increasing interest rate. Mine was floating. The officer who sold me the loan gave some misguiding concept "interest rate will go down when the economy is booming". But the reverse happened after I took the loan. I had a floating rate of 7% in Sept 2004. But within a year and half it almost crossed 12.5%.
I will try to find the email that ICICI sent regarding the part pre-payments terms.
Normally when the economy is booming, inflation will go up and central bank will increase the interest rate to contain that. The opposite will happen when the economy is going down

fatjoe,
There was an article that came out and here is the link to it: TSC-NSC update (http://imminfo.com/News/2009-AILA/TSC-NSC_update.html)
As the way I understood it, even your PD is not current, they are starting to pre-adjudicate some cases so that the Visa Center would know more or less how many visas are needed and how big the backlog is. This effort tries to eliminate unused visas and utilize most of it. So the way I see it is, USCIS pre-adjudicates cases, then those who are "pre-approve" will be sorted on a different place maybe database which will be submitted to the Visa Center. Now, once your PD comes (Visa Center is the one responsible for monthly Visa Bulletin), Visa Center will tell USCIS that this case is ok, USCIS then sends you your GC.
I was going through this forum and I have read some instances where the officer on the phone will or will not tell you if your case is pre-approve. So what they do is call back again and hoping that officer will divulge such information to you.
Thanks SL : Like I said before, the cust. rep. said that she did not have access to know check if the case is pre-adjudicated or not. So, I was wondering, how will the info would be accessible to any other cust. rep. May I be I will give it a shot one more time.

Good advice vamsi_poondla. Changing job is always a problem in I-485 stage. Making this more flexible is one of the administrative fixes IV is proposing in the letter to the President. One more reason for everyone to mail that letter, if not mailed already.
correct please get to the core problem rather than duscussing the cursory nature of AOS status. We need to get a resolution to our problems. Please post the letters...!!

I have received the EAD card and not the AP approval so far. Its been about 30 days since the AP approval was put in the mail.
I called couple of times to see if they can re-send it. Both the times they said, if you have not moved since you applied the petition and has not received the approval then you should re-file all over.
How far is this correct?
Has anyone faced this kind of stuff???
Thanks

GC wont put you in any better position. You are basically hiding, the day the interpol comes after you, they dont care you have a GC you will be arrested and deported. They can have your address and knock on your door anytime.
You might get away with everything and get a green card. I hope you did not do anything wrong.
